Milpitas Files Appeal Over Permits to Expand San Jose Landfill

Milpitas officials, believing the nearby Newby Island Landfill and Resource Recovery Park is largely responsible for emitting unhealthy odors into the city's air, filed a petition this week requesting a formal hearing to fight the granting of permits to expand the garbage dump on the San Jose-Milpitas border.

On Monday, Milpitas' legal counsel sent San Jose's Department of Planning, Building and Code Enforcement Division, Local Enforcement Agency, or LEA -- one of the main solid waste permitting agencies on this project -- a request for an administrative hearing.

"Milpitas is seeking a hearing before a neutral hearing panel or hearing officer to consider serious deficiencies in the permit application and permit process," Milpitas City Attorney Mike Ogaz said Tuesday.
