Judge Halts Enforcement of County Law, Supports Argument in NSWMA Lawsuit

Wayne County, Mich. -- Judge Marianne Battani of the United States District Court for the Eastern District of Michigan has issued a preliminary injunction halting the enforcement of a county ordinance that prohibited Wayne County landfills from accepting waste from jurisdictions that do not have a beverage container law like Michigan’s, according to the National Solid Wastes Management Association (NSWMA). The NSWMA filed a lawsuit Sept. 5 challenging the ordinance, arguing it violates several key provisions of the U.S. Constitution.
