Federal Appeals Court Upholds Flow Control Issue

New York - The Second Circuit Court of Appeals has reversed a prior federal district court decision, ruling that New York's Oneida and Herkimer counties' flow control rules are exempt from the Commerce Clause because the counties designated a publicly owned waste disposal facility. The decision was handed back to the federal district court, where it originally was supported by the 1994 U.S. Supreme Court decision, C&Carbone v. Town of Clarkstown, which ruled that flow control is prohibited.

EPA To Review Diesel Sulfur Rules

Washington, D.C. - The U.S. Environmental Protection Agency (EPA) has announced that the Bush administration will create a panel of automakers, oil refiners, environmental groups and other experts to re-examine Clean Air Act standards that limit sulfur content in diesel fuel. The plan, according to the EPA, is to slightly adjust the current implementation schedule that requires a 20-fold sulfur reduction by 2006.

Republic Services Sells $450 Million in Notes

Fort Lauderdale, Fla. - Republic Services Inc. has sold $450 million in 10-year notes, according to joint book manager Banc of America Securities LLC.

Waste Management Reports Fiscal Results

Houston - Waste Management Inc. has reported net income of $191 million for the second quarter ended June 30, 2001, compared with net income of $300,000 for the same quarter last year. Revenue for the quarter was $2.92 billion, compared with revenue of $3.27 billion for the same quarter last year.

Pennsylvania DEP Funds Composting Certification Program

Grantville, Pa. - The Pennsylvania Department of Environmental Protection (DEP) will invest $300,000 in the Composting Infrastructure Development Grant, a pilot grant program designed to increase the state's yard and food waste composting programs.

Casella Sells Subsidiary, Announces Restructuring

Rutland, Vt. - Casella Waste Systems Inc. has named James W. Bohlig president and COO and Charles Leonard senior vice president of solid waste operations. Jerry Cifor will resign as CFO, and Ross Pirasteh, chairman of the board, and Marty Sergi, an executive vice president and board member, have resigned. The company also has sold its Timber Energy Resources Inc. subsidiary, which includes a biomass incinerator in Telogia, Fla., and a wood-chipping facility in Cairo, Ga.

- Komatsu America International Co., Vernon Hills, Ill., and Qualcomm Wireless

Business Solutions, San Diego, have announced an agreement to provide Web-based information and network service solutions for construction equipment asset tracking on Komatsu’s Komtrax system.

Alliances

- Fedmarket.com, Tempe, Ariz., has appointed Environmental Support Solutions (Environ.com), Ketchum, Idaho, as its environmental compliance expert.

- J.J. Keller &Associates Inc., Neenah, Wis., has partnered with the National Paint &Coating Association (NPCA), Washington, D.C., to become the exclusive provider of the NPCA’s Hazardous Materials Identification System (HMIS) products and services.

Awards

- The Association of Postconsumer Plastic Recyclers (APR), Arlington, Va., has awarded Unilever Personal Home and Personal Care USA, New York, N.Y., its Creative Use award for using post-consumer plastic resin in its plastic product bottles and for donating 100 percent recycled plastic lumber to 55 national parks and playgrounds.
