Washington, D.C. — The Supreme Court recently announced that it will not review a federal appeals court decision that upheld an Environmental Protection Agency (EPA) regulation on polychlorinated biphenyl (PCB) use and disposal. After the Fifth Circuit ruled in favor of the EPA, the Utility Solid Waste Activities Group, General Electric Co. and individual utilities asked the Supreme Court to review the decision. The action leaves standing an August 2000 decision by the U.S. Court of Appeals for the Fifth Circuit, known as the PCB Mega Rule.
