Pennsylvania Board Upholds Federal Railway Regulations

The Surface Transportation board has upheld recent federal regulations by ruling that Hainesport Industrial Railroad, Hainesport, Pa., would not be subject to local oversight for transporting solid waste.
Phillyburbs.com reported that the three-member federal board ruled transportation included facilities used to move property by rail, which also includes transloading operations. Despite not having read the ruling, Darryl Caplan, owner of Hainesport Industrial Railroad, was quoted as saying the ruling was good news for his business. Nevertheless, he noted that his company signed a contract with Hainesport in 2006 agreeing to only transport construction and demolition debris and ruling out the transportation of municipal waste.
