City to Pay Portion Of Landfill Contract

The Washington City Council agreed Monday night to pay a portion of the final requested payment to J.H. Berra Construction for work done at the city’s landfill.

Because the project was finished significantly past the agreed upon deadline, the city is withholding $133,000 from the final payment in the form of liquidated damages. Instead the city will pay Berra $269,421.61 of the $402,426.61 remaining on the contract.

City Administrator Jim Briggs said the liquidated damages amount was reached by penalizing Berra $950 a day for the 140 days the project was finished past deadline.

“This was the most we could hold back,” Briggs said.

The payment was needed because the city needed to comply with prompt payment laws. Briggs said the city was withholding payment, but needed to pay Berra for the portion of the contract that both parties agreed was completed.
