N.C. Attorney General Says State Was Within Its Rights to Block Landfill

A state law that killed a mega-landfill project in Camden County is constitutional, the North Carolina Attorney General's Office said in response to a lawsuit filed by Waste Industries.

In the response, filed Monday, Attorney General Roy Cooper denied that the law is unconstitutional or that the Camden landfill was specifically targeted by the state General Assembly. The state has requested that the lawsuit be dismissed.

But the suit will likely go beyond Wake County Superior Court, said John Morrison, attorney for Camden County. The county is not involved in the suit, but Morrison is following the case.

"I don't expect it would be resolved in Superior Court," he said Wednesday.
