Illinois Landfill to Pay $100,000 in Lawsuit Settlement

After a lawsuit was filed against Advance Disposal Services (ADS) in 2020, Attorney General Kwame Raoul announced a $100,000 settlement with ADS Orchard Hills Landfill Inc. in Davis Junction, Illinois.
The settlement stemmed from Raoul’s complaint from May 2020 over the landfills air pollution and failure to collect and control landfill odors.
Since the lawsuit went into motion in 2020, ADS made several improvements such as no longer accepting construction debris containing drywall fines, which generates hydrogen sulfide gas and causes odor. Also, the landfill installed more gas collectors and additional piping to improve landfill gas collection.
Raoul’s settlement mentions that the ADS improvements have significantly reduced the overall waste acceptance from 7,000 tons to 2,500 tons of waste per day.
With the settlement, ADS will also take action to monitor the local area each week for off-site landfill odors. Odors attributed to the landfill with need to be investigated by ADS and it will oversee implementing corrective measures to the gas collection system components.
“Landfills operating in our state must be properly maintained to limit off-site odors and ensure they are not impacting nearby communities,” Raoul said. “I appreciate Advanced Disposal Services’ cooperation to make significant improvements to collect and control landfill gas and minimize impact to the surrounding community.”
ADS also must pay the aforementioned $100,000 as a civil penalty, among other orders.
