U.S. Senate Passes Landfill Gas Tax Credits

Washington, D.C. — The U.S. Senate on Wednesday passed a corporate tax bill that includes a landfill gas tax-credit measure. The bill now moves on to President George W. Bush, who is expected to sign the bill into law, according to The Solid Waste Association of North America (SWANA), Silver Spring, Md., which has long advocated for the credits. The bill, H.R. 4520, features a Section 45 credit for energy produced from landfill methane gas (LFG). Under the terms of the bill, landfill gas facilities that become operational between the enactment of the legislation and the end of 2005 would be eligible for a credit equal to $.9 per kilowatt-hour of energy produced for five years.
