EPA Seeks Comments on RCRA Instructions and Forms

The Environmental Protection Agency (EPA) is planning to submit an information collection request (ICR) for “RCRA Subtitle C Reporting Instructions and Forms,” according to a Federal Register posting.

Before doing so, however, the EPA is soliciting public comments on specific aspects of the proposed information collection. This is a proposed extension of the ICR, which is currently approved through May 30, 2020. Comments must be submitted on or before December 6.

The Resource Conservation and Recovery Act (RCRA) requires hazardous waste generators to report, at least every two years, the quantity and nature of hazardous waste generated and managed during that reporting cycle. It also requires treatment, storage and disposal facilities (TSDFs) to report any waste received and requires any entity that generates or transports regulated waste or owns or operates a facility for the treatment, storage or disposal of regulated waste to notify the EPA of its activities, including the location and general description of activities and the regulated wastes handled. The entity is then issued an EPA identification number and uses a notification form to notify EPA of its hazardous waste activities.

RCRA also requires TSDFs to obtain a permit by submitting an application describing the facility's operation. The RCRA Hazardous Waste Part A Permit Application form defines the processes to be used for treatment, storage and disposal of hazardous wastes; the design capacity of such processes; and the specific hazardous wastes to be handled at the facility.
