Washington, D.C. -- U.S. District Judge Richard W. Roberts refused on Friday to block the Bush administration's plan to move the U.S. Environmental Protection Agency's (EPA) ombudsman's office from the Office of Solid Waste and Emergency Response (OSWER) to the Office of Inspector General (IOG).

Robert Martin, EPA ombudsman, filed suit against the agency last year, claiming that the move would weaken his independence. As ombudsman, Martin handles citizens' Superfund and waste complaints.

According to EPA administrator Christie Whitman, the move currently is underway.
