NSWMA Challenges Michigan, Again

Washington, D.C. – The National Solid Waste Management Association (NSWMA) has filed a lawsuit challenging the constitutionality of several bills signed into law on March 26 by Michigan Gov. Jennifer Granholm. The agency has challenged laws that ban the disposal of various nonhazardous waste materials within the state. This action follows NSWMA’s recent, successful lawsuit against Wayne County, Mich., where an ordinance attempted to prevent area landfills from accepting waste from jurisdictions that did not have similar state container deposit laws. The ordinance was struck down.

"We regret … again seeking relief in the courts on this issue, however, we must act to protect our member’s constitutional rights," Bruce Parker, NSWMA president says.
