Indiana Residents Voice Concerns Over Waste Treatment Plant

Residents in Niles Township, Ind., have raised concerns about a proposed waste treatment plant. The facility would be operated by Earth Smart Environmental Solutions. Some residents have raised concerns about the township treasurer is also a commercial real estate broker with the Mishawaka real estate firm Newmark Grubb Cressy & Everett, was a broker in the sale of a property for $199,000 to Earth Smart.
Earth Smart is seeking a special land use permit for the facility. The company works with federal facilities to disposal various types of waste, including non-hazardous, hazardous, universal and medical waste.
David Hux, co-owner of Earth Smart, said in an interview last week, “It is so heavily regulated that it is probably one of the safer industries that you can have.”

At last week's hearing, the planning commission tabled its discussion and deliberations on the request. Several commission members publicly voiced a desire to have more time to research issues mentioned at the public hearing. The commission, which has final say on Earth Smart's request, could meet on or before July 12 to make a decision.
Planning commission members strongly denied accusations of automatically reaching a favorable decision on Earth Smart's request — and that development of the waste treatment, storage and disposal plant was a “done deal.”
“To sit there and accuse us of already reaching a conclusion is totally inaccurate and I'm actually ashamed of these citizens of our township for that,” commission member David Spurlock said at the end of the public hearing.
