A federal lawsuit against Lafayette Consolidated Government for prohibiting construction and operation of a waste transfer station after initially approving its permits was dismissed Tuesday.
Progressive Waste Solutions, formerly known as IESI LA Corporation, filed the lawsuit seeking damages for increased transportation and disposal costs, loss of income and use, and other fees and costs.
U.S. District Judge Richard Haik dismissed the lawsuit, writing that Progressive failed to meet its burden of proof.
