A trial is underway in Cleveland, Ohio to determine if one of the operators of the East Cleveland Arco Recycling dump will have to repay the state the money it spent cleaning up the site.
The site was operated as a dump for construction and demolition debris, not a recycling facility. The actions created a risk of toxins such as arsenic, lead and asbestos leeching into groundwater and exposed nearby residents to airborne pollutants.
The Ohio Environmental Protection Agency cleaned up the site at a cost of more than $9.1 million.
