Property Owner Files Lawsuit Against Scranton, Pa., for $300 Trash Pickup Fee

In December 2016, a property owner filed a lawsuit against Scranton, Pa., for its annual $300 trash pickup fee, claiming it’s both arbitrary and excessive.

Now, the property owner has filed a motion to get the lawsuit declared a class action. If the judge approves the property owner’s request, thousands of people who paid the fee in recent years may “opt-in” as co-plaintiffs and potentially be eligible for unspecified refunds.

An owner of several rental properties in the city, Guiffrida sued in December challenging the annual $300 trash fee as arbitrary and excessive. The lawsuit says the garbage fee should only cover the cost of providing the service and should not generate extra revenue for city coffers.
