The San Diego City Council approved the settlement last week, but the settlement still needs final approval from a judge because it’s a class action lawsuit that could potentially affect hundreds of drivers.

A class action lawsuit filed in 2014 claims the city failed to properly pay hundreds of drivers by deducting half an hour for a lunch break each shift, even though drivers are required to stay on their collection routes while eating lunch.
The city, which declined to admit any wrongdoing despite agreeing to a settlement, contends it doesn’t owe the wages because its status as a “charter city” exempts it from applicable state laws.
